Bunge La Mwananchi leader Evans Kawala Jasuba, aka Kidero Jasuba, stunned his own advocates at the High Court while responding to questions when he appeared in court on Thursday, May 28. His replies came close to admitting guilt, prompting his lawyer, Embakasi East MP Babu Owino, to step in and stop him from weakening his case.
Prosecutors charged Jasuba with inciting Kenyans to commit a terrorist act against President William Ruto during his address at the Jacaranda grounds. When the court put the charge to him directly, his response drew laughter from people in the room.
“These words were calculated to incite the Kenyan public to carry out a terrorist act against the Head of State. Evans Kawala, have you understood the charge? Is it true or not true?” a court official asked.
Kawala replied, “Yes, I understand, but that one is just content.”
When the court posed the question a second time, Jasuba gave another puzzling answer that prompted Babu to whisper, “Don’t talk,” to him, while another lawyer nearby looked down in visible disappointment.

The court recorded a plea of “not guilty” and moved the matter forward. Babu then stood up and asked the court to grant his client reasonable bail or release him on personal bond terms.
“The bail and bond policy of the court stipulates that cash bail or bond should be applied in a manner that suggests that it is not punishing before trial. This accused person is still innocent, and even if you look at his face, there is still innocence in him,” the MP told the court.
Babu successfully secured Jasuba’s release on a Ksh50,000 cash bail or Ksh500,000 bond, with the case set to return to court on June 22.
“Having considered that the prosecution is not opposed to the grant of bail and bond, the accused person may be set at liberty upon securing a bond of Ksh500,000 with one surety of the same amount. In the alternative, the accused person may be released upon depositing cash bail of Ksh50,000 with one contact person,” the judge stated.
Officers from the Directorate of Criminal Investigations arrested Jasuba in Kayole. The DCI pushed back against abduction claims and confirmed that officers detained him specifically for making inciting remarks.
