Mumias East Member of Parliament Peter Salasya is now a free man after the Milimani Magistrate’s Court approved the withdrawal of a hate speech case that had been hanging over him for months.

Senior Resident Magistrate Paul Mutai delivered the ruling after confirming that the outspoken legislator had fully complied with all conditions set by the court and the National Cohesion and Integration Commission (NCIC) under an out-of-court settlement agreement.

In his determination, Magistrate Mutai found that Salasya had taken concrete and verifiable steps to promote peace and social cohesion, as required before the court could allow the case to be withdrawn. The court noted that the MP had actively engaged in peace campaigns that directly reached at least 1,000 people and had sustained an ongoing peace initiative across his social media platforms.

“The evidence placed before the court shows that the accused has complied with the conditions imposed,” Mutai ruled.

The magistrate added that peace-building efforts were not a one-off exercise but a continuous process, noting that Salasya had demonstrated a clear commitment to sustaining the initiative beyond the court’s directive.

Following this finding, the court formally ordered the withdrawal of the charges under the relevant provisions of the law, effectively closing the case.

The decision followed an application by the Director of Public Prosecutions (DPP), presented in court by prosecution counsel Nora Achieng. The DPP informed the court that Salasya and the NCIC had resolved the matter amicably, opting for reconciliation and restorative justice rather than a full criminal trial.

According to the prosecution, the agreement sought to advance peace, reconciliation, and social cohesion, aligning with the broader public interest objectives of the justice system.

However, the court had earlier declined to immediately terminate the proceedings, insisting that Salasya first meet strict conditions outlined in the agreement. These included issuing a public apology and actively participating in peace and cohesion campaigns, particularly on social media, where the alleged offensive remarks had been made.

Magistrate Mutai had directed that formal proof of compliance be presented before the court could consider withdrawing the case, a move aimed at ensuring accountability and meaningful engagement in peace-building efforts.

The hate speech case dates back to May 19, 2025, when authorities charged Salasya over inflammatory statements he allegedly posted on social media. Prosecutors argued that the remarks targeted members of a specific community and amounted to hate speech and incitement under Kenyan law.

At the time, the prosecution maintained that the statements had the potential to inflame tensions and undermine national cohesion, prompting the intervention of the NCIC and the criminal justice system.

With the court now satisfied that Salasya has fulfilled all the agreed conditions, the withdrawal of the case brings the legal proceedings to a definitive end.
