Former Nairobi Central Officer Commanding Station (OCS) Samson Taalam has secured a modest legal victory after a Milimani court ordered Safaricom to facilitate the renewal of his mobile phone line, clearing the way for him to regain control of the number.
Appearing before Magistrate Carolyne Nyaguthii, Taalam’s lawyer told the court that repeated efforts to replace the SIM card had failed because the telecoms provider allegedly insisted on a court order before taking any action. The lawyer said Safaricom declined to renew the line without a formal directive from the court.
The defence argued that Taalam urgently required the order to reclaim his mobile number, which he claims investigators misused after seizing it during ongoing investigations. According to the submissions, the former OCS lost control of the line after authorities took his phone, exposing him and his family to alleged abuse.
Magistrate Nyaguthii allowed the application and directed Safaricom to facilitate the renewal of Taalam’s mobile phone line.
The ruling came as Taalam continued giving testimony in a case in which he accuses officers from the Independent Policing Oversight Authority (IPOA) of misusing his seized phone to solicit money from his relatives and associates while he remained in custody.
IPOA officers confiscated Taalam’s phone as part of investigations into the murder of Albert Ojwang, who died while in custody at the Central Police Station.
While testifying, the former police boss told the court that after he was detained following a miscellaneous application, a relative later informed him that unknown callers had reached out demanding money to “facilitate” his bail. Taalam said the callers asked for varying amounts ranging from Ksh.10,000 to as much as Ksh.80,000, claiming the payments would secure his release.
Disturbed by the calls, Taalam said he lodged formal complaints, insisting that someone had been using his phone without his consent. He testified that two IPOA officers, whom he identified as Jibril and Njihia, took possession of his phone alongside a photocopy of his national identity card.
He maintained that he surrendered the phone strictly for investigation purposes and not for any other use.
The Milimani Law Courts will mention the matter on March 25, 2026, for further directions as the case continues.
