Kenya has officially designated the Muslim Brotherhood and Hizb-ur-Tahrir as terrorist organizations under the Prevention of Terrorism Act (Cap. 59B).

Interior Cabinet Secretary Kipchumba Murkomen made the declaration through Legal Notice No. 157, published in the Kenya Gazette Supplement on September 19, 2025. He invoked Section 3(3) of the Act to make the declaration.

The directive, Prevention of Terrorism (Declaration of Specified Entities) Order, 2025, takes immediate effect and will remain in force unless revoked by the Cabinet Secretary or a court. Membership in, support for, or promotion of the two organisations, as well as raising funds for them, are criminalised by the order.

Under Section 3(3), money can be frozen, assembly prohibited, and anyone linked to proscribed organizations charged. The law also gives security agencies the power to investigate suspected cells, hold suspects in custody for extended periods with the court’s approval, and smash financial or logistical networks linked to the organizations.

Kenya is the latest country, after countries such as Egypt, Saudi Arabia, the UAE, Bahrain, and Russia, to formally designate the Muslim Brotherhood as a terror group.

The Brotherhood, founded in Egypt in 1928, is widely seen as the ideological root of modern political Islam and has established branches across the Middle East and North Africa.

Through invoking Section 3(3) to ban the two groups, the Interior Ministry has signaled that the directive contains no sunset clause and will remain in effect unless a court of law renders it null and void. With this enhanced legal support, security organs now have more authority to act with swiftness, enhancing Kenya’s status as a frontline state against the international war on terror.
