The National Cohesion and Integration Commission (NCIC) has said it will not use social media clips as evidence when it investigates hate speech and incitement cases. The commission said it will only act after it receives a formal complaint in line with legal requirements.
NCIC chairperson Bishop Dr. Kepha Nyamweya Omae said the agency operates under clear guidelines that govern how it carries out its mandate.
“Before we carry out any investigation, it is important for Kenyans to know there has to be complaints. You don’t begin to act on TikTok clips,” he said on Tuesday while addressing the press.
He added that acting without a formal complaint would place the commission in an awkward position, particularly because the clip submitted could be AI-generated.
“Until someone raises a formal complaint, it puts us in a very awkward situation because we don’t know whether the clip that was sent was AI-generated. We have to be sure it is a legitimate complaint.”
NCIC Names 10 Leaders Under Probe
The Commission said some of the complaints formally lodged have placed 10 prominent Kenyans under its scrutiny.
NCIC cited former Deputy President Rigathi Gachagua, Cabinet Secretaries Aden Duale (Health) and Geoffrey Ruku (Public Service), over remarks the commission believes may amount to hate speech or ethnic incitement ahead of the 2027 General Election.
It also named Busia Governor Paul Nyongesa Otuoma, Mandera Deputy Governor Ali Maalim Mohamud, Sirisia MP John Waluke, Wanjiku Muhia, David Gikaria, Tipape Naini Musa, and Dr. Dennis Adison Ouma.
The commission said its Investigations and Compliance Department is conducting independent probes into statements attributed to the individuals, adding that no one stands above the law.
NCIC appealed to political leaders to avoid mobilizing and deploying goons during political engagements and instead maintain political modesty as the country moves into a more intense campaign period ahead of the 2027 General Election.
