A new legal challenge has emerged against the leadership of the Central Organisation of Trade Unions (Kenya), with a petitioner seeking urgent court intervention to block the re-election of Francis Atwoli as secretary general.

The petition, filed by Francis Owino, argues that the recent election process violated constitutional standards. Owino has now asked the High Court of Kenya to step in immediately and prevent the newly elected COTU leadership from assuming office.

In his filing, Owino insists the case raises serious constitutional questions that demand urgent judicial attention. He maintains that the matter is too significant to wait until the High Court resumes its normal operations after its current recess.

As a result, the petition has already been placed before the court’s constitutional division for consideration.

Owino warns that delays could undermine the entire case. According to the petition, if the contested officials take office and begin making binding decisions, any eventual court ruling could become meaningless because the leadership would already have exercised its authority.

Dispute Raises Concerns Over Labor Governance

The petitioner argues that the election outcome carries major implications beyond internal union politics.

The Central Organisation of Trade Unions (Kenya) serves as the country’s main labor federation and represents millions of workers across various sectors. Owino states that the legitimacy of its leadership affects labor governance, institutional stability, and the integrity of national policymaking.

Because of these broader implications, the petition calls for immediate protective measures.

Owino is asking the court to issue conservatory orders to block the official registration of the newly elected leaders. Such orders would temporarily halt the leadership transition while the court examines the legality of the election.

According to the petition, this step would protect the core issues raised in the case and safeguard resources tied to the public interest.

The filing further argues that the court must act quickly to prevent the continued entrenchment of what it describes as unconstitutional processes. The petitioner also warns that allowing the leadership to proceed could open the door to potential misuse of authority.

Legal Battle Over COTU Leadership Continues

This latest petition adds another chapter to the ongoing legal disputes surrounding the leadership of the Central Organisation of Trade Unions (Kenya).

Recent attempts to challenge the election in the Employment and Labour Relations Court have already faced setbacks after the court declined to grant similar orders in related cases.

With the matter now before the High Court’s constitutional division, the judiciary will decide whether to intervene and temporarily halt the leadership transition at one of Kenya’s most influential labor organizations.
