The International Criminal Court (ICC) has officially closed its investigation into Kenya, drawing to a close a long-running chapter that once placed the country at the center of global justice debates.
But the case is by no means complete. The Court is still pursuing two fugitives who are alleged to have tampered with witnesses, keeping alive one unresolved strand of a saga that dominated Kenya’s political and legal landscape for years.
On November 27, 2023, the Office of the Prosecutor announced that it had completed its investigations into the Kenya situation. The declaration formally wrapped up the active ICC probe into events that sparked international attention and ignited heated conversations across the country.
Although the main investigation has been closed, the Court has retained a limited presence; ICC officials continue to monitor developments in Kenya and to hunt for two suspects still at large.
These outstanding warrants concern the alleged offences against the administration of justice under Article 70 of the Statute. The Court accuses the fugitives of corrupting or attempting to corrupt ICC witnesses, acts aimed at undermining the integrity of the judicial process.
“On 27 November 2023, the Office announced its decision to conclude the investigation in this situation. Following this decision, the Office’s activities have been limited to monitoring developments and tracking two suspects at large,” the report noted.
“They are the subject of warrants of arrest for alleged offences against the administration of justice pursuant to Article 70 of the Rome Statute, consisting of corrupting or attempting to corruptly influence ICC witnesses.”
These alleged violations include attempting to interfere with testimony or otherwise manipulate witnesses, offenses that the Rome Statute treats as serious threats to international justice.
The report underscores that the ICC’s role in Kenya has now narrowed significantly. Beyond pursuing the two fugitives and watching ongoing developments, the Court has scaled down all other involvement.
No new investigations will follow the decision to close the case, marking a definitive end to one of the most consequential international legal inquiries in Kenya’s history.
