Former Kiambu Governor Ferdinand Ndung’u Waititu alias Baba Yao has told a Nairobi court that he has secured a bank guarantor in the corruption case that sent him to Kamiti Maximum Prison, where he is currently serving his sentence since February this year..
Waititu appeared before Trial Magistrate Rose Ndobi on Tuesday for a mention in his separate hate-speech case. Through his lawyer, he announced that he had lined up a Ksh. 53 million bank guarantee, a key requirement that could pave the way for his release.
The court noted that once Waititu deposits the Ksh. 53 million guarantee, authorities may release him because his earlier bond terms in the hate-speech case are still valid.
Magistrate Ndobi set the hearing of the hate-speech matter for January 15, 2026.
Investigators say Waititu made inflammatory utterances on September 29, 2024, at the Ruiru Stadium in Kiambu County.
The charge sheet claims he targeted several groups, including hustlers, market vendors, boda boda riders, clergy, and teachers, and crafted statements meant to “provoke a breach of peace” and hint at violent outcomes against political leaders.
The prosecution argues that his alleged words contraven the provisions of Section 94(1) of the Penal Code, which criminalizes offensive conduct likely to cause a breach of the peace. They contend that Waititu uttered the words in public and meant to stir up animosity in his listeners.
