The Kahawa Law Court will today(Wednesday, November 19) issue its ruling on whether to grant the Anti-Terror Police Unit (ATPU) permission to detain prominent lawyer Chacha Mwita for 20 days as officers investigate alleged terror-linked activities.
Police arrested Mwita in Mombasa over the weekend and accused him of facilitating terrorist acts and offering services to terrorist organisations. Following his arrest, police officers transferred him to Nairobi, where he remained in custody for the entire weekend.
Prosecutors argue that ongoing investigations have linked Mwita to a recruitment network in the coastal region believed to be guiding young people to join terrorist groups. Detectives also claim he operated multiple mobile phone numbers used to receive funds from Binance accounts they believe bankroll terror activities in Kenya and abroad.
State counsel James Machirah presented these allegations before Principal Magistrate Gideon Kiage, but Mwita’s defence team strongly challenged the claims.
Advocates Lempaa Soyinka and Ayota Magati argued that representing terror suspects in court is not a crime, insisting the case appears designed to intimidate lawyers who defend individuals accused of terrorism. They maintained that Mwita is being targeted for carrying out his professional duties.
Mwita, who has spent more than a decade building a reputation for defending clients charged with terrorism offences, now faces accusations similar to those he has long contested on behalf of others.
If the court grants the request of the ATPU, Mwita will be detained at the Industrial Area Police Station as investigations continue.
Authorities say they are pursuing additional arrests linked to terrorism networks and a suspected cryptocurrency financing syndicate.
