A Nairobi court has denied an application for the release of the passport of IT expert and social media commentator Ndiang’ui Kinyagia, currently under investigation for undisclosed offences.
During the hearing, prosecutors informed the court that investigators had confiscated several documents from Kinyagia and that the Director of Public Prosecutions (DPP) was reviewing possible charges. They argued that releasing the passport could interfere with the ongoing probe.
“I am inclined to object to the release of the documents as it will compromise the ongoing probe,” the state counsel told the court.
His lawyer, however, urged the court to consider his client’s urgent situation, saying Kinyagia needed to travel to India to accompany his ailing sister for treatment.
“He does not know why his yellow fever card and passport are being held. No reasons have been given by the respondents. Health does not wait: the travel to India is an emergency,” the lawyer said.
The court refused to give interim orders for the release of the passport after reviewing the submissions, instead ordering Kinyagia to file formal written submissions, with the matter scheduled for ruling on January 15, 2026.
