The Milimani Chief Magistrates Court has ordered Kakamega-based blogger Simon Asiviela to publicly apologize to Lugari MP Nabii Daraja Nabwera over a series of defamatory social media posts.
The posts falsely implicated the legislator in the death and disappearance of Munyuki High School Principal Simon Isiaho Shange, claims the MP described as baseless and politically motivated.
“The court ruled that Asiviela must apologize for the ‘malicious, false and unqualified publications’ widely circulated on platforms including Kakamega Post, Malava Online, and Lugari Watchdog,” said court documents.
The interim order, issued pending the full hearing of the case, followed an application filed by MP Nabwera through his lawyer, Danstan Omari. In his affidavit, the MP explained that the posts incited public anger, with some individuals threatening to “occupy” and vandalize his home, placing his family at risk and tarnishing his reputation.
Through his lawyers, Nabwera sought urgent conservatory orders to restrain further defamatory publications and Ksh.20 million compensatory damages for reputational damage.
The court certified the matter as urgent, granting the public apology order. Under the directive, Asiviela must retract the posts and issue a public apology, signaling a firm stance against online defamation and reinforcing accountability for content shared on social media platforms in the wake of the recent contentious Computer Misuse and Cybercrimes (Amendment) Act, 2024 amended by President Ruto on October 15, 2025.
