
The High Court refused to stop the prosecution of Bomet Governor Hillary Barchok over graft allegations.
Barchok had rushed to court under a certificate of urgency, asking judges to block his arrest and trial.
This move came after the Director of Public Prosecutions (ODPP) approved charges against him last week, following investigations by the Ethics and Anti-Corruption Commission.
The ODPP also cleared the way for the prosecution of several other high-profile officials. It said the cases stemmed from investigations into county government operations that exposed claims of procurement fraud, conflict of interest, and misuse of public funds.
DPP Renson Ingonga confirmed that Governor Barchok will face charges of conflict of interest and unlawful acquisition of public property.
Investigators claim that companies tied to Governor Barchok received payments from the Bomet County Government between the 2019/20 and 2025 financial years.
On Monday, Justice Bahati Mwamuye ordered Barchok to serve his petition to the EACC in both soft and hard copies by Tuesday, September 2, 2025.
“The respondent (EACC) shall enter appearance and file and serve its response to both the application and the petition by close of business on September 19, 2025,” Mwamuye said.
The court also scheduled the case for mention on October 7 to give further directions on an expedited hearing and determination.
