
The Environment and Land Court has issued a warrant of arrest against Habanos Lounge director Maurice Asira after finding him in contempt of court for flouting noise pollution orders.
Justice Charles Mbogo, delivering his ruling virtually on August 28, 2025, directed that Asira, who manages Taks & M Habanos Chill & Grill Limited, must appear in court on October 22 to explain why he should not face jail time or fines for disobeying judicial directives.
The matter was initiated by a complaint by residents, headed by Mary Ann Wariithi, the petitioner group’s chairperson, who accused the entertainment venue of continuing to play loud music in disregard of a restraining order entered on October 17, 2024. The court was presented with evidence such as expert noise-level measurements and affidavits under oath, which established that the lounge continued to exceed the 35 decibels legal daytime sound level. The residents told the court that the management had acted with impunity, ignoring county enforcement and judicial authority.
Justice Mbogo underscored that court orders cannot be treated lightly.
“The 1st respondent is in total disobedience of this court’s orders and undermines the authority of the court. Such conduct will be dealt with firmly to prevent future defiance,” he ruled.
Although the judge stopped short of imposing penalties immediately, he ordered that Asira be presented before the court to face possible sanctions, including imprisonment or fines.
