A suspect who on Tuesday admitted guilt in the SIM swap case involving former OCS Samson Taalam has changed his plea.

When he appeared before Principal Magistrate Dolphina Alego at the Milimani Law Courts Wednesday, August 20, Dennis Masavi Musyimi denied fraudulently replacing Taalam’s phone line, which was allegedly used to solicit money from the public for personal gain.

Musyimi’s lawyer, Kioko, urged the court to grant him reasonable bail. He described his client as a young man who had just completed school and now works at an M-Pesa shop in Pipeline, adding that Musyimi posed no flight risk.

The defence also asked for a downward review of the bail terms, arguing that the other two suspects in the case had already secured their release on a bond of Ksh250,000.

“The other two accused persons were granted a bond of Sh250,000. We are asking the court to review the terms downwards in fairness,” Kioko submitted.

He went on to highlight the situation of the first accused, Nzomo Kimanzi, noting that he works as a mason, is married, and has two school-going children. Kioko insisted that Kimanzi also deserved lenient terms.

The prosecution, however, pushed for the case to be transferred to Court 7, where a similar matter is still pending, for purposes of consolidation.

“We request that the file be allocated there for purposes of consolidation,” the prosecutor told the court.

Magistrate Alego directed probation officers to prepare a pre-bail report and scheduled the case for mention on August 26, when the report and further directions will be given.
