Former Kiambu Governor Ferdinand Waititu walked out of Kamiti Maximum Security Prison on Thursday after the High Court drastically reduced his bail terms. The move marks a significant turn in his ongoing legal battle against a Sh588 million corruption conviction related to irregular road tenders.

The development unfolded during a mention of the case before the High Court’s Anti-Corruption and Economic Crimes Division. Waititu’s legal team confirmed that the former county boss had already secured his release following a successful application for a bond review.

“I am holding brief for the appellant, who is now a free man thanks to your orders,” stated lawyer Jeremy Njenga. He referred to directives issued by Justice Wilfrida Okwany, which finally paved the way for Waititu’s freedom.

Waititu had remained in custody since February 2025, after a trial court found him guilty of his role in the fraudulent award of a road construction tender. At the time of his conviction, the court imposed a Sh53.5 million fine or a 12-year jail term.

Initial bail terms required Waititu to post a Sh53 million bond backed by a bank guarantee, a condition his lawyers argued was practically impossible to meet. Recognizing that onerous bail terms shouldn’t keep a person detained indefinitely pending an appeal, Justice Okwany intervened.

The judge revised the requirement to a more realistic Sh20 million cash bail. This shift gave the former governor the room he needed to fight his conviction from outside the prison walls.

Consolidated Appeals and the Road Ahead

Waititu isn’t the only one challenging the 2025 verdict. The court also focused on his co-appellants, who are pursuing their own paths to clear their names. They include Luka Mwangi Wahinya, former Kiambu County Chief Officer for Transport, and Charles Chege Mbuthia, Director of Testimony Enterprises Limited.

Given that all three appeals stem from the same trial evidence and proceedings, the High Court has consolidated them into a single matter. This ensures a unified appellate process as the court reviews the original judgment.

The legal drama is far from over. The court directed all parties to return for a joint mention on April 14, 2026.

While the former governor has regained his freedom for now, he still faces the daunting task of overturning a conviction that barred him from public office. For the people of Kiambu and the Kenyan public, the upcoming appeal hearings will provide the final word on one of the country’s most high-profile graft cases.
