A prominent telecommunications provider finds itself in the crosshairs of a potential multi-million shilling court battle. Local businessman Alex Mutuku Mbalezi has stepped forward with explosive allegations, accusing the mobile phone company of illegally tracking his location and leaking his private data, actions he says directly triggered a harrowing ordeal of arrest and detention.

In a stern demand letter, Mbalezi’s legal team argues that the service provider blatantly violated his constitutional right to privacy. They contend that under Article 31 of the Constitution of Kenya, 2010, every citizen is entitled to the protection of their personal information.

Represented by prominent city lawyer Danstan Omari, Mbalezi asserts that the firm failed in its statutory and fiduciary duties. He maintains that as a customer, he trusted the company to safeguard his data and that any disclosure of his movements should have met strict legal and constitutional thresholds.

Allegations of Unlawful Tracking and Physical Harm

The core of the dispute centers on the claim that the company tracked and released Mbalezi’s real-time location data without a valid legal basis. According to the legal filing, this unauthorized surveillance led law enforcement directly to him, resulting in an arrest and subsequent detention that he describes as traumatizing.

Mbalezi alleges that police officers manhandled him while he was in custody, causing physical injuries that have led to ongoing health complications. Beyond the physical toll, the businessman reports significant psychological trauma and lasting damage to his personal dignity and professional reputation.

“Your actions directly facilitated the violation of our client’s fundamental rights and freedoms and exposed him to unlawful arrest,” the lawyers claim in the letter.

The Demand: Ksh 250 Million and an Admission of Guilt

The legal notice gives the telecommunications firm a narrow window to respond. Mbalezi is demanding a formal written admission of liability within seven days. Furthermore, he is seeking Ksh 250 million in compensation to cover the physical harm, psychological distress, and financial losses he incurred.

If the company ignores the seven-day ultimatum or refuses to settle, Omari’s legal team vows to escalate the matter to the High Court without further warning.

As data privacy becomes a central issue for Kenyan consumers, this case could set a massive legal precedent for how mobile operators handle sensitive user information and their level of cooperation with law enforcement agencies.
