Nairobi Court Fines Matatu Driver Who Fled Police Over Sudden Diarrhoea | BossNana International Radio

A matatu driver who dramatically sped away from a traffic police officer along Valley Road told a Nairobi court that he fled because he was suffering from acute diarrhoea.

Donald Owuor Ndeda, who drives a Ganya Sacco Isuzu matatu, appeared before Milimani Magistrates Court to face six traffic-related charges linked to the viral November 19, 2025 incident. A video circulating widely on social media showed Ndeda accelerating away after a traffic officer attempted to stop him.

The prosecution argued that the driver’s actions endangered other road users, amounting to reckless driving under the Traffic Act. He also faced charges for picking up passengers at an unauthorized spot on Valley Road, which contributes to congestion and unsafe boarding practices.

Further charges included failing to wear the mandatory Public Service Vehicle (PSV) uniform, violating Section 103A of the Traffic Act, ignoring verbal orders from a traffic officer, and failing to stop when directed. Ndeda had also skipped his first court appearance on November 21, earning an additional charge for failure to appear for plea taking.

Defending himself, Ndeda told the court that he did not intend to evade arrest, claiming instead that a sudden, uncontrollable bout of diarrhoea forced him to rush off in panic.

The magistrate, however, noted that medical reasons did not excuse his dangerous conduct on the road.

After considering the charges, the court imposed a total fine of Ksh 70,000, warning Ndeda and other PSV operators that endangering the public and ignoring lawful police commands would not be tolerated.
