A High Court judge has declined to issue an arrest warrant against Inspector General of Police Douglas Kanja for failing to produce missing security analyst Mwenda Mbijiwe, even as the case enters its fourth year without answers. Instead, the Milimani High Court directed the IG to appear in person on December 3, 2025, to explain Mbijiwe’s whereabouts and account for the prolonged disappearance.
While issuing the directive, the judge expressed concern that the IG, the Directorate of Criminal Investigations (DCI), and the Director of Public Prosecutions (DPP) have repeatedly ignored court orders requiring them to present Mbijiwe before the court whether “dead or alive”.
This was the second time in two weeks that Justice Martin Muya had ordered the IG and DPP to produce the former Kenya Air Force officer, whom authorities had failed to present in court.
The matter resumed in court on November 19, 2025, when the DPP requested more time to go through the investigation file forwarded by DCI. The prosecuting counsel informed the court that the DPP would only respond after going through the materials.
The court further heard that the DCI had submitted the file to the DPP following a letter from prosecuting counsel DK Chebii seeking clarity on the status of investigations. Part of the letter stated: “Kindly appraise us whether there are active investigations in connection with the issues regarding Mwenda Mbijiwe.”
Chebii informed investigators that the High Court required this information before making any adverse rulings.
The lawyer for the family, Evans Ondieki, pressed for stronger action by applying for a warrant of arrest against the IG and DCI to force them to account for Mbijiwe’s disappearance. However, the DPP objected to the request and requested more time, further delaying the long-running case.
