Juja MP George Koimburi Freed on Bail in KSh10M Land Fraud Case | BossNana International Radio

Juja MP George Koimburi walked free on Monday after the Milimani Magistrate’s Court released him on a KSh100,000 cash bail. He had pleaded not guilty to four charges of conspiracy to defraud in a KSh10 million land dispute.

Koimburi, alongside Shelmith Karungri Maina and Gathi Irungu, is accused of conspiring to defraud businessman Julius Gitonga of a 1.31-hectare parcel of land in Ruiru East/Juja East, valued at KSh10 million. The counts included conspiracy to defraud, forgery, obtaining registration of land by false pretences, and uttering false documents.

During the plea session, Koimburi’s lawyer urged the court to grant him a free bond, arguing that the complainant had already appeared in court and signaled willingness to withdraw the case. The defence also said the MP was not a flight risk, had consistently honored court summons, and risked losing his parliamentary seat if absent for eight consecutive sittings.

“The complainant has already indicated willingness to withdraw this matter. My client is therefore not a flight risk and deserves to be granted a free bond,” the lawyer told the court.

“The accused is a sitting MP for Juja Constituency. There is no incentive for him to abscond,” the defence added.

The prosecution, however, opposed the request for a free bond but said it had no objection to his release under lenient bail terms. They further informed the court that the Director of Public Prosecutions (DPP) had written to the court requesting a review of the charges facing the MP and his co-accused.

“The Office of the Director of Public Prosecutions has already written to this court requesting a review of the charges. We ask that the matter proceed in line with that directive,” the prosecution submitted.

The court also heard that the second accused, Shelmith Karungri Maina, had already been released on a KSh100,000 cash bail. The third accused, Gathi Irungu, did not take a plea after his counsel explained that he was out of the country, sick, and undergoing medical treatment.

The magistrate directed the case to be mentioned on October 22 at 9:00 a.m. at the Milimani Law Courts.
